Paul Diver is a highly experienced leadership and business team facilitator, organisation development and change consultant and employment relations advocate/adviser.

Paul established the Paul Diver Associates Employment Relations consulting business in 1991 and currently leads a consulting team of nine Associates.

Paul has represented and advocated for employers across a wide range of business and organisation sectors since 1979 and has been consistently successful in creating high level results for those clients.  Paul and the team currently negotiate or advise on the negotiation of 24 Collective Agreements including the (multi employer) Plastics Industry Collective Agreement.

With Paul’s past success in facilitating strategic planning, leadership, business/organisation alignment and team development workshops and coaching clients at the senior leadership team level with IAS Learning Group internationally and IAS New Zealand for NZ clients, Paul has now partnered (as a Director) with other Facilitators and Coaches to create 5 Degrees Consulting to continue this work.  Paul has and continues to work extensively in the Sports Sector facilitating the Sport NZ sponsored Chief Executive Leadership Programmes since 2010 and the High Performance Sport  New Zealand Leadership Programmes from 2013.

Paul is a law graduate of the University of Canterbury and was admitted as a Barrister and Solicitor of the High Court in 1979 (Paul does not however hold a Practicing Certificate from the Law Society). Earlier career roles include being an Employment Advocate with the State Services Commission and the NZ Employers Federation, and Director Human Resources for NZ Breweries Ltd (Lion).

Paul is also an Associate of the Arbitrators’ and Mediators Institute of New Zealand, and a member of the Employment Law Institute of New Zealand.

Dispute Resolution and Investigations Expert

Lynn provides our clients with quality employment relations expertise. As a Labour Inspector with the Department of Labour (now MBIE), she investigated claims of breaches of minimum entitlements, exploitation of vulnerable workers and general inspection complaints. This role included interviewing and investigating complaints, forensically examining information and evidence, reaching an opinion or in some cases making a determination.

Having been a Mediator at MBIE for nearly 10 years and mediating approximately 2000 matters, Lynn is highly experienced in conflict resolution. Lynn has mediated the full spectrum of employment and work related matters, including on-going employment relationship problems, disputes arising out of interpretation of collective agreements, recovery actions, personal grievances, collective bargaining and grievances that arose out of a principal/contractor arrangement.

In her role as Labour Inspector and as a Mediator, Lynn also wrote and delivered training to external stakeholders to enable them to understand rights and responsibilities and put in place processes to ensure best employment practices.

At Paul Diver Associates, Lynn is developing the mediation practice, assisting our clients in conflict resolution and undertaking investigations. Lynn also works with employers to assist them in best practice processes and procedures to put them in the best possible position to conduct their employment related processes in line with the requirements of the legislation and limit the risk an employer may have if there is a dispute.

Anna Jones

Associate Director

Anna has joined us with extensive experience in employment relations and dispute resolution, having led over 2000 mediations to resolution involving a broad range of issues. As a professional mediator, Anna has worked in a number of different jurisdictions including employment, commercial, human rights, sports, weathertight and tenancy.

Over recent years Anna has specialised in the more complex conflicts that can arise within employment which are often difficult to define but have a significantly detrimental effect in the workplace such as bullying. Anna often works with large groups and is able to tailor her approach to fit the particular issues and people involved.

Anna also has significant experience assisting parties in collective bargaining and has been involved in some of New Zealand’s most high profile industrial relations disputes in recent history. Anna has mediated bargaining impasses across a number of different industries including transport, education, energy, retail and healthcare.

Anna has both a Bachelor of Laws and Arts from Auckland University and was admitted as a barrister and solicitor of the High Court in 2003 (although she does not hold a current practicing certificate). Anna has advanced mediation accreditation with LEADR (Lawyers Engaged in Alternative Dispute Resolution) and is also an accredited Conflict Coach, which enables her to work one on one with individuals to address issue of conflict and to develop conflict management processes.

Anna lectures in both employment relations and conflict resolution. Anna has also designed and delivered a significant number of presentations and workshops for large conferences and for smaller teams.

Anna will work across the range of services that we provide with a focus on advocacy in Collective Bargaining, Investigations and the development of a Mediation practice for the business.

Natalie Cooper

Natalie joined the consultancy in January 2010 with a generalist human resources and recruitment background gained from her experience in the FMCG and general manufacturing, engineering, and tourism / leisure industries.

During her time at Paul Diver Associates, Natalie has provided advice and advocacy on a range of employment relations matters including performance management and disciplinary processes, medical incapacity, dispute resolution and personal grievances, training and development, employment agreements and contracts for services (independent contractor arrangements).

Natalie has also successfully managed many restructuring and recruitment projects, providing end-to-end services from restructure proposals and redundancy processes through to creating new job descriptions, advertising, screening and interviewing candidates.

Natalie has undertaken postgraduate study through Auckland University of Technology, and has recently completed her Master of Laws. Her studies have included papers in Dispute Resolution, Business Restructuring, Comparative Human Rights and an independent research topic comparing the Human Rights and Employment jurisdictions for the resolution of discrimination and harassment claims. Through her studies, Natalie has polished her research and writing skills and has become effective at solving complex legal-based employment problems.

Natalie is also available to attend formal meetings, provide representation at Mediation or the Employment Relations Authority, undertake negotiations, and facilitate records of settlements for her clients.

Robyn Commins

Bachelor of Business Studies majoring in Management and Human Resources from AUT

Robyn joined the consultancy in 2003, with extensive knowledge in operations management and an excellent understanding of business finance, having had roles in Manufacturing, Operations, Finance and start-up companies with responsibilities for her own staff.

Robyn graduated with a Bachelor in Business Degree, majoring in Management and Human Resources in 1996 and then redirected her career to HR.  She is passionate about assisting her clients to make their businesses more productive and profitable.

Robyn is a highly proficient generalist; she has assisted clients with restructuring, change management, recruitment, performance management, disciplinary processes, training and development, employment agreements, policies and procedures, employment agreements, and occupational health and safety. Robyn has also successfully represented many clients in Mediation and the Employment Relations Authority.

Collective Bargaining has become a skill Robyn has also acquired, managing the entire process from creating a bargaining strategy, drafting claims, developing collective employment agreements and concluding bargaining.

Bachelor of Commerce majoring in Marketing and Management from the University of Auckland

Kim provides our clients with practical advice and assistance at each stage of the employment lifecycle from recruitment through to redundancies and termination of employment.

Working closely with our clients allows her to have a thorough understanding of their culture and how they operate on a day to day basis. Kim is available to provide Human Resource support for small to medium businesses who may not have their own HR department but still require someone to provide employment relations skills and expertise.

Kim has experience with developing and reviewing policies, contract for services (independent contractor agreement), individual employment agreements and collective agreements, to ensure they comply with legislation and meet the needs of our clients businesses. She also assists with collective bargaining processes and supports our team to produce creative solutions for a win-win situation. Kim is available to advise on a number of employment relations matters but can also actively assist with the process to ensure our clients meet their obligations.

Karen joined the consultancy in November 2010 and brings vast administrative experience to the consultancy. Having worked with some of New Zealand’s foremost corporate entities including Pricewaterhouse Coopers, IAS Learning Group, Sealord Products, Lion Breweries, and New Zealand Wines & Spirits, the team are lucky to have Karen coordinating the office.

Karen’s strengths are in creating an efficient and highly functional business, advisory and administrative environment, thereby supporting her colleagues to create exceptional outcomes for our clients.

With the creation of the 5 Degrees Consulting business in 2014, Karen has become an expert in establishing systems and creating resources for a number of large-scale leadership development programmes. Evolving into an event planner, training coordinator, and communications manager, Karen is the critical link to every aspect of the business.

Karen also assists the team with the review of employment agreements and policies, collating and editing large documents, creating the Paul Diver Associates newsletters and sending out client communications.

Angela joined the team in July 2016 with a broad financial background gained from working in medium to large businesses in manufacturing, retail and wholesale industries.

Angela has experience across a wide range of financial functions and has held roles as management accountant, finance manager, and corporate analyst with responsibilities including management accounts, budgeting, cash management, forecasts, cost and cash flow analysis and various administrative duties.

Along with her accounting knowledge Angela has been involved in large-scale IT implementations including scoping, testing and enhancements.  She has an understanding of ERP systems and believes in utilising technology to improve efficiency and assist in the decision making process.

Angela enjoys an environment where she can be part of an enthusiastic team, where she can learn and expand her knowledge in both systems and accounting.  She is willing to assist where ever needed and describes herself as a “hands on” professional accountant who can translate accounting jargon to meaningful information to assist in making successful business decisions.

Angela will provide the finance function within the business and support the team with driving system efficiency and business improvements.
